1. THE AGREEMENT

These Terms & Conditions (“Terms”) constitute a binding contract between Phaedrus Trading & Services DBA Outriders Co. (“Company,” “we,” “us”) and the individual booking or participating in the tour (“Participant,” “Rider,” “you”). By paying a deposit, you confirm you have read, understood, and accepted these Terms. 

 

2. NATURE OF TOURS

You acknowledge that our tours are expedition-grade motorcycle adventures operating in developing nations (including but not limited to India and Vietnam). These are not standard holidays. Outriders Co. operates guided motorcycle adventure tours, which may include, without limitation: 

  • Long-distance highway riding 
  • Mountain roads and high-altitude passes 
  • Narrow, broken, gravel, dirt, sand, or uneven terrain 
  • Urban and chaotic traffic conditions 
  • Remote regions with limited infrastructure or medical facilities 
  • Rapidly changing or extreme weather 
  • Mechanical failures, rider fatigue, falls, or collisions 

Motorcycle adventure travel is inherently hazardous. Serious injury, permanent disability, or death may occur, even when all reasonable safety measures are taken. 

By booking and participating, you voluntarily assume all risks, known and unknown, foreseeable and unforeseeable. 

3. ELIGIBILITY & RESPONSIBILITY

You confirm that you: 

  • Meet minimum age and legal licensing requirements 
  • Possess sufficient riding experience for the selected tour 
  • Are physically and mentally fit for extended motorcycle riding 
  • Will follow all safety instructions and local traffic laws 
  • Will wear appropriate protective riding gear at all times 

The Company reserves the right to refuse participation or remove any rider if safety is compromised, without refund. 

4. PRICING & INCLUSIONS

  • Included: Motorcycle rental, fuel, accommodation (double occupancy), support vehicle (for groups above 6 persons), mechanic (for groups above 6 persons), road guides, inner-line permits, and breakfast/dinner (as specified in the itinerary). 
  • Excluded: International flights, visas, lunch, alcohol, personal travel insurance (mandatory), riding gear, damage deposits, and tips. 
  • Surcharges: We reserve the right to adjust pricing up to 30 days before departure due to drastic fluctuations in exchange rates or fuel prices. 

 

 

5. BOOKING & DEPOSIT

non-refundable deposit of USD $500 per rider is required to secure a booking. 

The deposit: 

  • Is non-refundable under all circumstances 
  • May be applied as future trip credit 
  • May be transferred to another rider with prior written approval 
  • Has no cash value 

Trip credits expire 24 months from the original tour start date unless otherwise stated in writing. 

 

6. PAYMENT SCHEDULE

After deducting the $500 deposit, the remaining balance is payable as follows: 

  • 25% – 120 days before tour start 
  • 25% – 90 days before tour start 
  • 25% – 60 days before tour start 
  • Final balance – 30 days before tour start 

All installment amounts are rounded to the nearest USD $100. 

Failure to make any scheduled payment within 7 calendar days of its due date may result in cancellation of the booking without refund. 

 

7. CANCELLATIONS & REFUNDS

Refunds apply only to amounts paid beyond the $500 deposit. 

  • 120–91 days: 50% refund of amounts paid 
  • 90–61 days: 25% refund of amounts paid 
  • 60 days or less: No refund 

No refunds are provided for no-shows, early departures, missed riding days, illness, weather conditions, or personal emergencies.

8. MOTORCYCLE DAMAGE

  • Damage Deposit: A refundable security deposit (cash or card hold) is required upon bike handover in the host country. 
  • Responsibility: You are responsible for the motorcycle while it is in your custody. You agree to pay for any damage caused by accidents, negligence, or dropping the bike. 
  • Mechanical Failure: The Company provides a mechanic and spares. In the event of a mechanical failure not caused by rider negligence, we will repair or replace the bike as quickly as logistics allow.

9. AUTHORITY ON TOUR

For the safety of the group, the Lead Guide (Road Captain) has absolute authority. 

  • If the Lead Guide determines your riding ability is insufficient or dangerous, you may be removed from the riding portion of the tour. No refund will be given. 
  • If you are found riding under the influence of alcohol or drugs, you will be immediately expelled.

10. ITINERARY CHANGES

Adventure travel requires flexibility. The Company reserves the right to alter the route, accommodation, or schedule without notice due to weather, politics (border closures), or safety concerns. Such changes are not grounds for a refund.

11. INSURANCE (MANDATORY)

 You must provide proof of comprehensive Travel Medical Insurance that specifically covers: 

  • Motorcycling as an activity (for the engine size you are riding). 
  • Medical Evacuation (Helicopter/Ambulance) up to at least $100,000 USD. 
  • Repatriation of remains. 
  • We strongly recommend “Cancel for Any Reason” (CFAR) coverage. 

 

12. CHANGES & FORCE MAJEURE

The Company may modify routes, schedules, accommodations, or support arrangements due to weather, terrain, safety considerations, mechanical issues, regulatory restrictions, or other operational factors. 

Force Majeure events (including natural disasters, pandemics, border closures, civil unrest, or government actions) may result in postponement, alteration, or cancellation. The $500 deposit remains non-refundable. 

Outriders Company operates as a U.S.-registered tour operator and maintains general commercial liability insurance. This insurance covers claims arising from proven negligence on the part of the company. Riders participate at their own risk and must carry comprehensive personal travel insurance including medical, evacuation, and accident coverage. Our liability insurance does not cover rider injuries, motorcycle damage, trip cancellations, delays, force majeure events, or airline disruptions. 

 

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law: 

  • The Company is not liable for injury, death, loss, delay, or damage arising from participation 
  • Any liability, if established, is limited to the amounts paid directly to the Company for the specific tour 

Participation requires signing a separate Release of Liability & Assumption of Risk Waiver, which forms an integral part of this agreement. 

 

14. INDEMNIFICATION

You agree to indemnify and hold harmless the Company from claims arising from your negligence, misconduct, breach of these Terms, violation of law, or damage to motorcycles, property, or third parties. 

 

15. MEDICAL EMERGENCIES

You confirm that you are medically fit to participate and authorize emergency medical treatment if required. All medical and evacuation costs are your responsibility. 

Travel medical and evacuation insurance is strongly recommended. 

 

16. CONDUCT & SAFETY

Riding under the influence of alcohol or drugs is strictly prohibited. Unsafe, disruptive, or reckless behavior may result in removal from the tour without refund. 

 

17. MEDIA CONTENT

Unless you opt out in writing to info@outridersco.com before departure, you grant the Company permission to use photographs and videos taken during tours for promotional purposes. 

 

18. GOVERNING LAW 

These terms are interpreted in accordance with the laws of the State of Wyoming, USA. Any dispute arising from this contract shall be litigated exclusively in the courts of Wyoming. 

 

19. ENTIRE AGREEMENT

These Terms, booking confirmations, and signed waivers constitute the entire agreement between you and the Company.
